1.0 End User License Agreement (EULA)
 

Developer: VG-3D Modelers & Railway Simulations.

Lead Developer(s): Varun Ganesh & Team.

Applicable To: All digital assets, 3D models, and software extensions (the "Product") provided by the Developer.


1.1 Grant of License

By purchasing, downloading, or installing any content from VG-3D Modelers & Railway Simulations, you are granted a non-exclusive, non-transferable license to use the Product for personal, non-commercial use within the intended simulation environment. All rights, titles, and interests in the Product remain the sole property of the Developer.
 

1.2 Intellectual Property Rights

All rights, titles, and interests in and to the Product are and shall remain the exclusive property of the Lead Developer(s). This includes, but is not limited to:

  • 3D Geometry: All meshes, polygons, and shape files (.s).

  • Artistic Assets: All textures, bake maps, and material settings (.ace, .dds, .png).

  • Configuration & Logic: All physics coding, sound engineering, and scripting (.wag, .eng, .sms).

  • Creative Brand: The VG-3D Modelers & Railway Simulations name, logos, and associated branding.

This Product is protected by copyright laws and international copyright treaties. Your possession, installation, or use of the Product does not transfer any title or ownership of intellectual property to you.
 

1.3 Disclaimer

This is an independent 3D artistic work. This product is not affiliated with, endorsed by, or sponsored by any government agency, transportation authority, or original equipment manufacturer. All real-world names, logos, and livery designs are used solely for descriptive and historical accuracy within the simulation environment. All trademarks remain the property of their respective owners.


1.4 Restrictions on Use and Distribution

You strictly may not:

  • Redistribute: Share, sell, rent, lease, sublicense, or host the original files on any public or private server, cloud service, or website.

  • Third-Party Benefit: Use the Product, or allow the Product to be used, to provide services to a third party, or otherwise make the functionality of the Product available to any third party for their benefit or commercial gain.

  • Modify: Alter any 3D models (.s), configuration files (.wag, .eng), or sound files included in this package.

  • Reverse Engineer: Attempt to decompile, disassemble, or extract assets from the 3D shape files or encrypted scripts.

  • General Compliance: Use the Product for any purpose or in any manner that VG-3D Modelers & Railway Simulations, at its sole discretion, deems a breach of this EULA or an infringement on the Developer's intellectual property.


1.5 No Repaints Policy

Repainting or texture modification of this Product is strictly prohibited. Unless a specific "Template" or "Repaint Kit" is officially provided by the Developer, repainting or texture modification is strictly prohibited.

  • You may not modify texture files (.ace, .dds, .png, etc.) for personal or public use.

  • The distribution of "skin packs" or "patch files" for the Product is not permitted.

  • Any unauthorized derivative works discovered online will be subject to a DMCA takedown request.


1.6 Commercial Use

This license is for private home entertainment only. You may not use this Product in any commercial environment, including paid training simulations or public exhibitions, without prior written consent.

 

1.7 Disclaimer of Liability

This Product is provided "as is" without warranty of any kind. The Developer shall not be liable for any damages (including, but not limited to, system errors or loss of data) arising out of the use or inability to use this software.


1.8 Termination

This license is effective until terminated. Failure to comply with the "No Repaints" or "Redistribution" clauses will result in the immediate termination of your license and may lead to further legal action.

1.9 No Refund Policy; Final Sale

As the Product consists of digital software, 3D geometry, and configuration files that are accessible immediately upon purchase or download, the following refund policy applies:

  • Final Sale: All purchases of the Product are considered final. Due to the irrevocable nature of digital downloads, VG-3D Modelers & Railway Simulations does not offer refunds, returns, or exchanges once the download link has been accessed or the files have been delivered.

  • No Refunds After Use: By downloading, installing, or accessing the Product files (including but not limited to .s, .eng, and .ace files), you acknowledge that the service has been fully performed. No demands for refunds will be entertained after the files have been accessed or used in a simulation environment.

  • Asset Integrity: The Developer guarantees the technical integrity of the provided files at the time of delivery. No refunds will be granted based on claims of file defects, as all Products are rigorously tested within the intended simulation environment prior to release.

  • User Responsibility/Compatibility: It is the User's responsibility to ensure their hardware and simulation environment meet the minimum requirements before purchase. Refunds will not be granted for technical incompatibility or "change of mind."


Notice: Any actions found to be violating this EULA shall be dealt with through strict legal action, including but not limited to DMCA filings and permanent blacklisting from future VG-3D Modelers releases.
