Terms and Conditions

1. Acceptance of Terms

By accessing VG-3D Modelers & Railway Simulations (the "Site") or downloading any digital assets (the "Product"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must immediately cease use of the Site and refrain from downloading or installing any assets.
 

2. Intellectual Property Rights

All rights, titles, and interests in and to the Product are and shall remain the exclusive property of VG-3D Modelers & Railway Simulations. Our Products are protected by copyright laws and international copyright treaties. Your possession, installation, or use of the Product does not transfer any title or ownership of intellectual property to you. 
 

3. Usage Licenses & Restrictions

By purchasing or downloading content, you are granted a non-exclusive, non-transferable license for personal, non-commercial use within the intended simulation environment.

You strictly may not:

  • Redistribute: Share, sell, rent, lease, sublicense, or host original files on any public/private server or cloud service.

  • Modify: Alter any 3D models (.s), configuration files (.wag, .eng), or sound files.

  • Reverse Engineer: Attempt to decompile, disassemble, or extract assets from shape files or encrypted scripts.

  • Commercial Use: Use the Product for any commercial gain or third-party benefit without express written consent.


4. User-Generated Content (Repaints)

Repainting or texture modification of our Product is strictly prohibited to maintain the artistic integrity of the models.

  • Prohibition: You may not modify texture files (.ace, .dds, .png) for personal or public use.

  • Exceptions: This restriction is only waived if a specific "Template" or "Repaint Kit" is officially provided by the Developer.

  • Enforcement: The distribution of "skin packs" or "patch files" is not permitted. Any unauthorized derivative works discovered online will be subject to a DMCA takedown request.
     

5. Digital Goods & Refund Policy

Due to the digital nature of our products (3D models and simulation files):

  • Final Sale: All sales are final once the download link has been accessed. Refunds will not be issued for "change of mind."

  • Compatibility: It is the user’s sole responsibility to ensure their hardware and software meets the requirements listed on the product page.
     

6. Limitation of Liability

In no event shall VG-3D Modelers be liable for any damages arising from the use or inability to use our assets, including:

  • System Failure: System crashes, data loss, or hardware failure (e.g., "Blue Screens") caused by high-poly models or improper installation.

  • Monetary Cap: Our total cumulative liability for any claim shall not exceed the actual amount paid by you for the specific Product in question.
     

7. Termination

VG-3D Modelers reserves the right to terminate your license to use the Product immediately and without notice if you fail to comply with any part of these Terms. Upon termination, you must delete all copies of the Product in your possession.


8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Maharashtra.
